Terms of Service

Please read these terms carefully before using Axelnest.

1. Acceptance of these Terms

By creating an account or using any part of the Axelnest website, mobile experience, marketplace, or related services (together, the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2. About Axelnest

Axelnest is a community platform built for figure skaters and their families. It provides skater profile tools, public-skate and freestyle session schedules for participating rinks, a peer-to-peer marketplace where skaters can buy and sell gear from each other, and Off-Ice Buddy, a training companion that gives families timers, streaks, and badges for running their own off-ice routines. Axelnest provides the tools — the routines themselves come from users (see Section 7).

3. Eligibility

You must be at least 13 years old to create an account. Skaters under 18 must use the Service under the supervision of a parent or legal guardian, who is responsible for the minor’s activity on the Service, including any marketplace transactions. Skater profiles for children may be created and managed only by the child’s parent or legal guardian, within the parent’s own account.

4. Your Account

• You agree to provide accurate, current, and complete information during sign-up and to keep it up to date.
• You are responsible for safeguarding your password and for any activity under your account.
• You must notify us promptly of any unauthorized use of your account.
• One person may not maintain multiple accounts to circumvent restrictions or ratings.

5. User Content

You retain ownership of content you submit to the Service (listings, photographs, profile details, messages, training routines, and exercise photos). By submitting content you grant Axelnest a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content as needed to operate and promote the Service. You represent that you have the rights to any content you upload.

Any content made available to you through the Service by another user remains the work of its author. You may use it only for your family’s personal, non-commercial purposes, and you must not re-share, sell, or republish it without the author’s permission.

In particular, routines a coach assigns to a linked skater remain the coach’s content at all times. Families view them through the Service and may run training sessions from them, but no copy is made, they cannot be edited or re-shared by the family, and access ends when the assignment ends or the coach link is disconnected by either side.

6. Marketplace

Axelnest provides a venue for skaters to transact directly with one another. Axelnest is not a party to any sale.

• Sellers are responsible for accurately describing items, setting fair prices, shipping promptly, and handling returns in accordance with Axelnest’s posted return policy.
• Buyers are responsible for paying on time, providing accurate shipping information, and inspecting items on receipt.
• Payments are processed by Stripe. By selling on Axelnest you also agree to the Stripe Connected Account Agreement.
• Shipping labels are issued through Shippo.
• Axelnest charges a platform fee on completed sales, disclosed at checkout.
• Returns follow the policy displayed in the marketplace at the time of purchase. Disputes that cannot be resolved between buyer and seller may be reviewed by Axelnest at its sole discretion.

7. Off-Ice Training & Assumption of Risk

Off-Ice Buddy provides timing, tracking, and motivational tools only. Axelnest does not create, provide, review, or endorse any exercise or training content. Routines are authored entirely by users — typically a skater’s family or coach — and Axelnest is not responsible for their content, safety, or suitability.

• A parent or legal guardian is responsible for ensuring that any routine is appropriate for their skater’s age, ability, health, and surroundings, and for supervising its use.
• Physical exercise carries an inherent risk of injury. To the fullest extent permitted by law, you assume all risks arising from participation in any routine run through the Service. Stop any activity that causes pain or discomfort.
• Nothing in the Service is medical advice. Consult a physician before beginning any exercise program, especially for a child.

8. Prohibited Conduct

You agree not to:

• List counterfeit, stolen, or otherwise illegal goods.
• Post content that is unlawful, harassing, hateful, defamatory, or sexually explicit.
• Upload content you do not have the rights to, including scanned pages or images from books, training guides, or another coach’s materials.
• Use the Service to spam, scrape, reverse engineer, or interfere with operation.
• Impersonate another person or misrepresent your affiliation with any person or entity.
• Circumvent fees, ratings, or safety controls.

9. Intellectual Property

All Axelnest branding, software, and original content (excluding user content) are the property of Axelnest or its licensors and are protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service without our written permission.

10. Third-Party Services

The Service relies on third parties including Supabase (database, authentication), Stripe (payments), Shippo (shipping labels), and Google (OAuth sign-in). Your use of those services is also subject to their own terms and privacy policies.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Axelnest disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, in no event shall Axelnest, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid Axelnest in the 12 months preceding the claim, or (b) USD 100.

13. Indemnification

You agree to indemnify and hold harmless Axelnest from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any lawful business reason. You may close your account at any time from your account settings or by contacting support.

15. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will provide notice (for example, by email or an in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Salt Lake County, Utah, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
